California just did something no state or the federal government has managed in more than two decades: it put a hard floor under how much energy your replacement tires are allowed to waste. The California Energy Commission approved the Replacement Tire Efficiency Program on August 17 by unanimous vote. Phase 1 bites in 2029, Phase 2 in 2033.
Before the pitchforks come out, understand what the rule actually regulates, because a lot of the loudest reactions are aimed at things it doesn’t touch.
Rolling resistance, in plain English
Rolling resistance isn’t friction between rubber and asphalt. It’s hysteresis. Every time a chunk of tread and sidewall rolls into the contact patch, it gets compressed, bent and sheared, then springs back — and rubber, being viscoelastic, doesn’t give back everything you put in. The difference leaves as heat. The CEC’s staff report lays this out precisely: energy goes in, warmth comes out, and you paid for it at the pump or the charger.

The metric is the rolling resistance coefficient, expressed in newtons per kilonewton — resistance force divided by load, which makes it dimensionless and comparable across tire sizes. Lower is better. Tested per ISO 28580:2018, and specifically correlated to the European Union’s numbers so a manufacturer isn’t running two different test regimes for two markets. That’s a bigger deal than it sounds; it means a tire already labeled in Europe arrives half-certified.
The gap the rule is actually chasing
Here’s the part that makes the whole thing make sense. Smithers laboratory testing commissioned by the CEC found original-equipment tires averaged 7.1 N/kN. Replacement tires averaged 8.5. Tires marketed as “efficient” landed at 7.5.
That 1.4-point spread is a structural artifact, not a conspiracy. CAFE standards score the car when it’s new, and low-rolling-resistance tires are one of the cheapest ways for an automaker to buy a tenth of a mpg on the certification cycle. The moment the odometer rolls past the OE tires’ service life, nobody has any obligation to preserve that number. So you buy a set of replacements, the fuel economy quietly drops, and you blame the injectors.
Staff proposed base tires drop from a 9.0 N/kN ceiling in the first phase to 7.1 in the second — which is exactly the OE average, because the 2003 statute demands parity, not superiority. The Commission’s final action pushed those compliance dates back to 2029 and 2033.
What’s exempt, and why enthusiasts should read this part
The amended regulatory text filed in July added a stack of carve-outs, and they’re more generous than the headlines suggest.
Competition tires are out entirely — defined as tread depth of 8/32 of an inch or less, a W, Y or (Y) speed rating, a UTQG treadwear rating not above 200, and not marketed as an all-season. That’s a workable definition of a 200-treadwear track tire, and it means your Rivals, RE-71RS-class rubber and R-compounds aren’t the target.
Ultra-high-performance tires get their own looser ceiling, defined as a W, Y or (Y) speed rating, 168-mph capability, and a wet grip index of at least 1.45 — a category that exists precisely because CEC’s own data showed genuine high-grip tires do carry a rolling-resistance penalty.
Also excluded: motorcycle tires, deep-tread tires at 18/32 or greater, winter snow tires, space-savers and temporary spares, off-road recreational tires, large off-road tires (Q-rated or below and 34.5 inches or more in diameter), anything with a load index of 122 or more, anything that can’t sustain 50 mph, and — importantly for the vintage crowd — anything with a nominal rim diameter of 13 inches or less. That threshold was moved up from 12 inches during the comment period.
All-season winter performance tires, meaning 3PMSF-marked rubber that hits a traction index of 112 or better, are exempt from the efficiency standard and from the wet grip standard. Run-flats got their own category. Limited-production tires under 15,000 units a year are only subject to reporting.
The safety backstop nobody asked for except the industry
The rule sets a minimum relative wet grip braking index of 1.0, tested per ISO 23671:2021 for passenger tires and ISO 15222:2025 for LT and commercial. That threshold came from the tire industry itself, which told the CEC it wanted a floor so no competitor could game efficiency at the expense of traction.
The Commission’s own numbers suggest it’s a formality: of 149 tire models originally tested, only seven scored below 1.0, and those averaged 0.96. This is a guardrail, not a cull.
What owners and shops need to know
The trigger is the date of manufacture, not the date of sale. The regulation applies to tires manufactured on or after January 1, 2029. Tires built before then stay legal to sell after the deadline. Learn to read the four-digit DOT date code on the sidewall — week and year — because between 2029 and 2033 that stamp is going to decide what’s on the rack.
Compliance runs on self-certification. Manufacturers report rolling resistance, wet grip, treadwear and the rest into a public CEC database under penalty of perjury, and the Commission can pull tires off shelves for verification testing. Results more than two standard deviations off the declared number push the model into an “archived” database — that is, off the legal-for-sale list. Labs that don’t hold their alignment can be barred for 90 days. Repeat offenders go to the Attorney General.

On cost, CEC pegs the increment at $1.50 per tire in Phase 1 and $6.50 in Phase 2 — about $26 on a set of four, $39 for light-truck sizes — against $179 in fuel over a four-year tire life, assuming $4.60 gasoline and 10,413 miles a year. Payback around seven months. Whether those assumptions hold in your driveway depends entirely on how much you drive and what fuel costs when you’re buying.
The bit that should actually annoy you
This authority came from AB 844, signed in 2003. The CEC started work, then paused in 2007 when Congress passed the Energy Independence and Security Act and told the Department of Transportation to build a national tire efficiency rating program. NHTSA issued test-method regulations in 2010, amended them in 2012, and then never adopted the rating system, never set a reporting date, never did point-of-sale disclosure. The 2015 FAST Act ordered minimum performance standards; that rulemaking stalled in 2017 with nothing adopted.
So a federal program that Congress mandated twice produced a test procedure and nothing else, and a state law from 2003 sat dormant for thirteen years waiting on it. California restarted its own effort in 2020. Whatever you think of the outcome, the twenty-three-year runway is the real story — and if you’d like one national tire label instead of a California-specific database, direct your complaints east.
