Welcome to Backfire News. These Terms of Service (“Terms”) govern your access to and use of the website located at backfirenews.com and any related content, features, and services (collectively, the “Site”), which is operated by Backfire News (“Backfire News,” “we,” “us,” or “our”). Please read these Terms carefully. By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.
PLEASE NOTE: These Terms contain a binding arbitration provision and a class-action waiver (Section 19) that affect your legal rights. Please read them carefully.
1. About the Site & Acceptance of Terms
Backfire News is an independent digital news and editorial publication covering automotive news, transportation issues, motorsports, public safety incidents, industry developments, social media trends, enthusiast culture, auctions, recalls, and related topics of public interest. Your continued use of the Site constitutes your acceptance of these Terms, as they may be updated from time to time.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Site. By using the Site, you represent that you meet this requirement and that you have the legal capacity to agree to these Terms.
3. Editorial Content, Opinion & No Defamation Intended
The Site contains news reporting, commentary, analysis, and opinion. Statements of opinion, analysis, and commentary represent the views and interpretations of the authors. Unless a statement is expressly identified as confirmed and supported by a named, verifiable source, any statement concerning a person, company, product, team, event, or organization should be understood as alleged, as a matter of opinion, and as our good-faith interpretation of the information available to us – not as a statement of established or proven fact.
Our coverage is offered as fair comment on matters of public interest and is not intended to defame, disparage, or harm the reputation of any person or entity, or to state or imply that any individual or organization has engaged in unlawful or improper conduct. The mention or depiction of any person, vehicle, brand, team, or business – including in headlines, photos, or captions – is not an accusation of wrongdoing and should not be read as one.
4. Copyright, Attribution & Content Use Policy
Our reporting may include commentary on, references to, or embedding of publicly accessible third-party materials, including social media posts, press materials, manufacturer assets, publicly available videos or images, screenshots, and other editorial source materials used for news-reporting, commentary, educational, archival, research, or informational purposes. We strive to provide attribution where appropriate and operate in good faith under applicable United States copyright, fair use, and news-reporting principles.
As this publication contains a substantial archive of previously published material created over multiple years, certain historical content may contain embedded media, attributed references, third-party materials, or legacy editorial formatting practices that may not reflect current standards or policies. The continued presence of archived content does not constitute a waiver, admission, or concession regarding ownership, licensing status, fair use applicability, or legal characterization of any specific material.
Backfire News respects the intellectual property rights of photographers, journalists, creators, publishers, agencies, and rights holders. Original content created by Backfire News – including text, graphics, and layout – is owned by us or our licensors and may not be copied, reproduced, republished, or redistributed without our prior written permission, except as permitted by law.
5. Trademarks
“Backfire News,” our logo, and other marks used on the Site are trademarks of Backfire News or used under license. All other product names, brand names, logos, and trademarks appearing on the Site are the property of their respective owners and are used for identification and editorial purposes only. Their use does not imply any affiliation with, sponsorship by, or endorsement by those owners.

Repeat Infringers. It is our policy, in appropriate circumstances and at our discretion, to limit access, remove content, or otherwise act with respect to users or contributors who are determined to be repeat infringers.
Archived & Legacy Content
Backfire News maintains a substantial archive of previously published material created over time. Certain historical content may contain embedded media, attributed source references, third-party materials, or legacy formatting practices that do not reflect our current editorial standards or policies. The existence of archived content does not constitute a waiver, admission, or concession regarding ownership, licensing status, fair-use applicability, or the legal characterization of any specific material. If you believe any archived item requires review, please contact us at contact@backfirenews.com and we will address it in good faith.
Nothing contained on this website shall be construed as intentional infringement, misappropriation, or waiver of any legal rights, defenses, protections, or remedies available under applicable law. All rights are reserved by their respective owners.
7. Acceptable Use
You agree not to use the Site in any way that is unlawful, harmful, or that interferes with others’ use of the Site. Without limitation, you agree not to: violate any applicable law or regulation; attempt to gain unauthorized access to the Site, its servers, or related systems; introduce viruses, malware, or other harmful code; scrape, harvest, or collect data from the Site by automated means without our permission; copy or republish our original content beyond what the law allows; or post or transmit any content that is unlawful, defamatory, harassing, infringing, or otherwise objectionable.
8. User Submissions & Third-Party Content
The Site may allow you to submit tips, photos, videos, comments, or other materials (“Submissions”), and a significant amount of the material we publish originates from third parties, readers, social media, and other external sources. We do not create, control, or independently verify all such material, and we cannot guarantee its accuracy, completeness, authenticity, or origin. Opinions or statements submitted by or attributed to third parties are those of the submitter or source and do not necessarily reflect our views.
By making a Submission, you represent and warrant that you own or have all necessary rights, licenses, and permissions to the content, that it does not infringe the rights of any third party, and that it is not unlawful. You grant Backfire News a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, edit, adapt, publish, display, and distribute your Submission in any media in connection with the Site and its promotion. You are solely responsible for any content you submit, and you agree to indemnify and hold us harmless from any claim arising out of it. We are under no obligation to publish, and may edit, refuse, or remove, any Submission at our sole discretion.
9. Comments & Community Conduct
If the Site permits comments or other interactive features, you are responsible for your contributions and agree to keep them lawful and respectful. We may, but are not obligated to, monitor, moderate, edit, or remove comments and may suspend or block users at our discretion. Comments reflect the views of the individuals who post them, not Backfire News.
10. Newsletter & Communications
If you subscribe to our newsletter or other communications, you consent to receive emails from us. You may unsubscribe at any time using the link provided in those emails. Any promotions, giveaways, or contests we run are void where prohibited and may be subject to additional rules; we reserve the right to modify or cancel them at any time.
11. No Professional Advice
Content on the Site is provided for general informational, news, and entertainment purposes only and is not intended to be, and should not be relied upon as, professional, legal, financial, mechanical, safety, or technical advice.
12. Assumption of Risk & Release
Motorsports, off-road driving, vehicle modification, and related activities are inherently dangerous and can result in serious injury, death, or property damage. Any technical descriptions, build details, product information, or how-to content on the Site is shared for general interest only and may be incomplete, inaccurate, or unsuitable for your situation. You assume all risk associated with any use of, or reliance on, such content, and you are solely responsible for your own safety and decisions and for complying with all applicable laws, manufacturer instructions, and safety practices. To the fullest extent permitted by law, you release Backfire News and its owners, contributors, employees, and agents from any and all claims arising out of your use of or reliance on the Site or its content.
13. Disclaimer & No Warranties
The Site and all content are provided on an “as is” and “as available” basis, without warranties of any kind. To the fullest extent permitted by law, Backfire News disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Site will be uninterrupted, secure, error-free, or free of viruses or other harmful components, or that any information on the Site is accurate, complete, or current.
14. Limitation of Liability
To the fullest extent permitted by law, Backfire News and its owners, contributors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your access to or use of (or inability to use) the Site or any content, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages. In no event shall our total aggregate liability to you for all claims exceed one hundred U.S. dollars (USD $100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
15. Indemnification
You agree to defend, indemnify, and hold harmless Backfire News and its owners, contributors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Site, your Submissions, or your violation of these Terms or of any law or the rights of a third party.
16. Third-Party Links
The Site may contain links to, or embedded content from, third-party websites and services. These are provided for convenience only. We do not control and are not responsible for the content, accuracy, policies, or practices of any third party, and a link or embed does not constitute an endorsement.
17. Advertising
The Site is supported in part by advertising, including Google AdSense. We do not allow advertisers to influence our editorial decisions. For more information about how we handle data and advertising, please review our Privacy Policy.
18. Changes to These Terms & to the Site
We may update these Terms from time to time at our sole discretion. Changes are effective when posted, and the “Last updated” date above reflects the most recent revision. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. We may also modify, suspend, or discontinue the Site or any part of it at any time without notice.
19. Dispute Resolution, Binding Arbitration & Class-Action Waiver
Please read this section carefully – it affects your legal rights. Except for disputes that qualify for small-claims court and except for claims seeking injunctive relief related to intellectual property, you and Backfire News agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall be resolved by final and binding individual arbitration, rather than in court, before a recognized, neutral arbitration body in accordance with its rules and applicable law. You and Backfire News waive any right to a jury trial and agree that claims may be brought only on an individual basis and not as a plaintiff or class member in any purported class, collective, or representative proceeding. If the class-action waiver is found unenforceable, the remainder of this section shall continue to apply, but the unenforceable portion shall be severed. You may opt out of this arbitration agreement by sending written notice to the contact below within 30 days of first accepting these Terms.
20. Time Limit to Bring Claims
To the extent permitted by law, any claim or cause of action arising out of or related to your use of the Site or these Terms must be filed within one (1) year after the claim arose; otherwise, it is permanently barred.
21. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States and the state in which Backfire News is established, without regard to conflict-of-law principles, and without naming any specific jurisdiction in this document. Nothing in this section limits any mandatory consumer-protection rights you may have under the laws of your place of residence.
22. Miscellaneous
Entire Agreement. These Terms, together with our Privacy Policy and any notices posted on the Site, constitute the entire agreement between you and Backfire News regarding the Site and supersede any prior agreements.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
Assignment. You may not assign these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
Force Majeure. We are not liable for any failure or delay resulting from causes beyond our reasonable control, including acts of God, outages, network or hosting failures, or other events outside our control.
Headings. Section headings are for convenience only and do not affect interpretation.
